Legal Advice

Buying a property in Spain involves legal and administrative procedures that may differ significantly from those in your home country. For this reason, we strongly recommend appointing an independent property lawyer from the outset to protect your interests and ensure a smooth and secure transaction.
A good property lawyer will help you:
- Understand Spanish property law and how it applies to your purchase
- Navigate complex areas such as inheritance rights, taxation, planning regulations, and building permits
- Review and explain contracts and legal documentation
- Ensure all legal requirements for purchasing a property in Spain are met
- Identify and advise on any risks, irregularities, or potential issues
With the right legal advice, you can proceed with confidence, make informed decisions, and avoid potential legal or financial consequences resulting from insufficient due diligence.
Legal representation
- If you already have your own lawyer, we will work closely with them throughout the entire purchase process.
- If you do not yet have legal representation, we can introduce you to independent property lawyers we work with, who have extensive experience assisting our international clients.
- These lawyers act exclusively for you as the buyer, ensuring your interests are fully protected throughout the process.
- You are under no obligation to use a lawyer introduced by us and remain free to appoint a legal representative of your choice at any stage of the transaction.
What your lawyer will handle
- Full legal due diligence on the property
- Verification of ownership at the Land Registry
- Checks for debts, charges, mortgages, or embargoes
- Confirmation of outstanding community fees, local taxes (IBI), and utility bills
- Review and explanation of reservation agreements and private purchase contracts
- Advice on purchase costs, taxes, deadlines, and payment schedules
Administrative assistance
- Application for your Spanish tax identification number (NIE)
- Opening of a Spanish bank account
- Liaison with notaries, banks, and public authorities
- Representation at the Notary on completion
- Registration of the title deed in your name
Power of Attorney
- Recommended if you are not residing in Spain or cannot attend in person
- Allows your lawyer to sign contracts and deeds on your behalf
- Covers the entire buying and/or selling process
- Can be granted before a Spanish Notary or in your country of residence
Post-completion services
- Payment of purchase taxes within legal deadlines
- Transfer of utilities (electricity, water, rubbish collection, community fees, etc.)
- Guidance on ongoing legal and tax obligations, including non-resident taxes
By ensuring independent legal representation from the beginning, whether through your own lawyer or one introduced by us, you benefit from a transparent, secure, and stress-free purchasing process.
